    There was a very subtle part of this story that I'm sure many defense lawyer's might have cringed at.  After the driver was read his rights (the Miranda warning "You have the right to remain silent"etc)  it went like this:

driver: I have the right to lose my job I know

cop: Well dude you're not found guilty.

driver: What?

cop;  You're not guilty.

a:  Yeh I am..i am

    The above confession is a real tough one to get out of. The cop was being nice, trying to help the guy out!  You sure wouldn't argue that "My client was too drunk to understand his rights,"   Anyway , he seemed like a nice guy but what was he thinking? Stopping for a few drinks when your job is to drive people home safely on New Year's is not the brightest idea.

Wow John!

I feel sorry for the driver; that he had to learn such an expensive lesson. He seems like a nice guy; but New Years Eve is no excuse to drive intoxicated. Driving trusting clients makes it much worse!
Can you imagine the lawsuit the limo company would have had against them if he crashed?
If there is a lawyer out there that can convince a judge that he is not guilty with that video, I definitely want that lawyer's phone number for future reference.

Thanks for your comments as always. I'm sure the guy had that little voice in his head telling him "don't drink" and the other little voice telling him "ah come on...just one or two" He should have listened to the first voice.

Oh yeah, I know the voices... Or as Jonny Bowden would call them, "Gremlins"
The same voices that convince me to sabotage my diet and exercise plans all the time.
"I plead not guilty your honor; it was the Gremlins that made me do it!" It's true, but a judge would bust a forehead vein if he heard that. LOL!

Holy cow! This guy was driving for a living and thought he'd have a few drinks before his next pick-up?? Judging only by his size and the rate of alcohol consumption in humans vs. their body mass, his assertion of having only a couple of beers seems unlikely. I think the officer was correct. Folks, if you like to enjoy a drink or two (or three) on the job, don't drive for a living...please!

I;m surprised that when the couple in the car realized that he was driving erratically they didn't use their cell phones instead of taking a chance to be in an accident.

John, is there more to their side of this?

Aili,

I believe the female passenger notcied the swerving and asked her boyfriend about it. At about the same time, the car was pulled over. It's not like they ignored it, they were just processing it at the time.
